RESERVATION REQUIREMENTS. To book the Premises there is a non-refundable down payment of 30% plus a non-refundable property protection fee dependent on the size of your rental property. If the total of the reservation is less than Down payment, half of the total will be charged as the new Down payment. We will block the dates when the non- refundable down payment is received. Once the down payment has been paid, you will need to print a copy of this rental agreement, sign it and send it to us along with a copy of your driver license. If any monies are paid via credit card, you will need to fill out the credit card authorization form. The balance is collected 60 days prior to the scheduled arrival date. TERM. All provisions of this contract pertaining to Tenant responsibilities, charges or the like that should reasonably survive the termination of this Agreement, shall so survive. Check in time is 4:00 pm; check out must occur by 10:00 am. In some cases if the Premises are ready earlier than 4:00 pm, we will allow Tenant to check in early. If we don't have anyone checking in the day of your check out we will allow Tenant to check out late for an additional fee. Please call 48 hours prior to your departure to confirm this is available. If tenants disregard check in and check out times, extra time at the house will be billed to the tenant at a rate of $100 per hour billed in one hour increments unless other arrangements are made in writing by us. It is the responsibility of the Tenant to inform manager of Tenant`s approximate arrival time at least 24 hours in advance to make arrangements for check-in during normal business hours (9:00 AM - 6:00 PM). Please let us know the approximate arrival time. PAYMENT IN FULL. Payment in full is due 60 days in advance of scheduled arrival date Tenant is responsible for assuring payment is received by Carefree Vacation Homes in US Dollars for the full balance owed. If this deadline is not met, Carefree Vacation Homes may choose to rent the premises to another party. If that occurs, any and all deposits shall be forfeited by the Tenant. In the event Tenant is unable to take possession of the premises or cancels a reservation, all monies paid to Carefree Vacation Homes shall be nonrefundable to tenant, including but not limited to any rent unless otherwise agreed by Carefree Vacation Homes in its sole and absolute discretion. Any refund for cancellation less than 45 days prior to reserved occupancy period shall be in the sole discretion of Carefree Vacation Homes. PROPERTY PROTECTION FEE. Our non-refundable property protection fee is in lieu of paying a security deposit when reserving your rental property. This non-refundable required fee protects you from damage which results from an accident within the property. The program does not cover negligent or willful and wanton conduct. You must notify Carefree Vacation Homes of any damage to the Premises during your occupancy. See the “Property Protection Fee Description” at the bottom of this document for detailed information. The property protection fee is charged to your credit card at the time the non-refundable down payment is charged. CREDIT CARD AGREEMENT. Tenant will be providing a valid credit card number as a guarantee of deposit payment to Carefree Vacation Homes. In the absence of deposit check Tenant understands Carefree Vacation Homes will use the credit card as backup to cover any expenses incurred by Tenant and not covered by the rental fee or property protection fee. LAST MINUTE RESERVATIONS. If the reservation is made less than 60 days before check in full payment is required. TRAVEL INSURANCE. Carefree Vacation Homes recommend purchasing travel insurance to cover any travel or health issues. Carefree Vacation Homes are not responsible for any tenant not being able to make their vacation dates. OCCUPANCY. Tenant takes full responsibility to ensure that no more than the contracted number of individuals are on or in said premises at one time. Parties with additional guests are expressly forbidden. SMOKING. All properties are Non-Smoking. The Premises are being strictly rented as a non- smoking property. The Tenant hereby agrees not to allow anyone to smoke inside the Premises during the rental period at any time. The Tenant hereby understands and agrees that if smoking is detected in the Premises, the Tenant will be charged $1000 for professional cleaning and/or deodorizing to remove smoke odor. The property protection fee will not cover smoking inside any unit and Tenant will be completely responsible for professional cleaning and/or deodorizing to remove smoke. ANIMALS. No animals are permitted. Any damages from an unauthorized pet will be charged to the tenant’s credit card. In the event that a pet is found on the premises the Tenant shall be in violation of this Agreement and will be charged accordingly and Carefree Vacation Homes retains the right to sue Tenant for damage to the Premises. HOUSE RULES. Tenant agrees to abide by all house rules. Tenant also agrees that jumping off any structure is strictly forbidden and will result in an immediate termination of access to the Premises without refund. Also, for safety and legal reasons, all fences must be kept shut when an adult is not present and Tenant agrees to ensure that all minors on the Premises are supervised by an adult at all times. EVENTS. There are no special events allowed in the premises. Special events include weddings, parties, and large gatherings exceeding the contracted number of people. Tenant will be evicted if there is an event held on premises. ORDINANCES AND STATUTES. Tenant will comply with all statutes, and ordinances of all authorities. There is a 10:00 pm noise ordinance enforced by the city and must be complied with. If Tenant or his party violates any of the house rules or ordinances Beach Time Rentals will promptly notify Tenant of the violation and give Tenant a reasonable period within to cure violation. If Tenant fails to cure violation, Tenant is subject to eviction from the property at Beach Time Rental’s discretion. ASSIGNMENT AND SUBLETTING. Tenant may not assign this Agreement without prior written consent of Beach Time Rentals. MAINTENANCE AND DAMAGE. Tenant acknowledges that, unless we are notified immediately upon occupancy, the Premises, including the furniture, furnishings and appliances, are in good working order and repair. Tenant agrees that no representation as to condition of repair of the Premises has been made except as is contained in this Agreement. Tenant will keep the Premises in a sanitary condition, and will notify us of any damage to the Premises or its contents, or any inoperable equipment or appliances. Tenant will surrender the premises, at expiration or earlier termination, in as good a condition as received, normal wear and tear accepted. Tenant acknowledges that if the Premises are left in an exceptionally unclean or unsanitary condition, cleaning charges will be assessed at a rate of $150 per hour and will be charged to the Tenant`s credit card. Tenant will be responsible for any damage due to misuse caused by Tenant or his or her family, invitees and guests. It is understood that Homeowners insurance does NOT cover Tenant`s personal property. AIR CONDITIONING. The temperature on the Air Conditioning Unit should be set no lower than 75 degrees and on the AUTO/COOL. To ensure the unit runs smoothly please ensure all windows and doors are closed. POOL. If a hot tub or pool is provided at the rental property, it will be prepared, cleaned and tested for proper and safe chemical levels by a certified pool and spa operator, prior to or on the day of occupancy. If any of the following conditions exist at any time during your occupancy, call Carefree Vacation Homes immediately and discontinue use until the Pool/Spa contractor has serviced the tub or pool and notified Guest it is safe for use: a) Water clarity is milky or bottom of tub/pool is not visible; b) Foam forms on surface when using jets; c) Misuse of tub/pool by spilling foreign substances (a Service Call Charge applies in this instance). Absolutely, no pets are allowed in the Hot Tubs and Pools. Tenants, his or her family, invitees and guests of special attention including, but not limited to, pregnant women, elderly, and disabled persons should use heavy caution while using the hot tubs and pools. Tenants, his or her family, invitees and guests are to swim at their own risk. Adult supervision required in pool and hot tub area when children are present. It is the tenant’s responsibility to learn about safety precautions, warning signs of water conditions, and safety procedures concerning swimming in or being around the pool. Tenant is hereby notified that the hot tub and pool can be dangerous and Tenant accepts fully the risks involved. Tenant is further notified to be cautious when exiting the rear of the home as the pool is open and in close proximity to the entry ways and can be a hazard. There are no rails to prevent a fall into the pool. Beach Time Rentals will not be held responsible for hot tub and pool injuries or discomforts. The operation, maintenance, heating, and lifeguard coverage for any rental supplying a swimming pool will not be guaranteed by the Owner or Beach Time Rentals POOL HEATERS. Pool heat is an extra charge, the cost is $35 per day at 85 degrees. If you wish to pay for pool heating please do so at the time of booking. All pool heaters can take up to 24 hours to heat from the time when turned on. Pool heaters have electrical/mechanical components, and these components can sometimes malfunction. Carefree Vacation Homes, its Vendors, and the Owner cannot be held responsible if for reasons beyond their control, heating cannot be restored promptly. Please inform us as soon as possible if the pool/ Jacuzzi is not working properly. Carefree Vacation Homes will do everything in its power to rectify any problems with malfunctioning equipment as quickly as possible. Pool temperature is set by Manager (at 85 degrees) and regularly checked by a sensor. Use of a higher temperature will result in a heating surcharge as Excess Cost and will be billed to your credit card. Some of our pools have pool covers, the pool cover must be on the pool if no one is swimming. This cover will keep the pool heated. PERSONAL ITEMS. Beach Time Rentals is NOT responsible for guests' personal belongings that are lost, stolen, or left behind. If it is necessary to return to Tenant any items found, Carefree Vacation Homes may charge Tenant a $15 fee, or the actual cost of return, whichever is higher. CLEANING. After maintenance finishes prepping the rental property for check in, a cleaning crew is assigned to prepare the premises for check in. All of our properties are professionally cleaned before you arrive and after you leave. We expect to have the premises in excellent condition when you arrive and would appreciate your assistance in leaving the unit in a reasonable condition upon your departure. Upon arrival in the event Tenant finds a cleaning failure please report it to the office within 90 minutes of check in so that we can remedy any matters, we will send our cleaning crew. However; no refunds will be made after we send our cleaning crew. Carefree Vacation Homes will make every effort to satisfy the requirements of each Tenant. If we have not heard from you within four hours of check-in, we will assume that you are satisfied with the cleanliness of the home. At check out: Any excessive cleaning needed at checkout will be charged on the card on file. PEST CONTROL. Many different pests live and thrive in this region. Your unit has been professionally treated by a commercial pest control company with precise and complete preventative treatments in an effort to keep all the pests and bugs outside. Should you experience a pest control issue, please contact Carefree Vacation homes may attempt to eradicate the problem. REFUNDS. Carefree Vacation Homes cannot guarantee against mechanical failure of heating, air conditioning, hot Tubs, elevators, pool heaters, televisions, satellite Receivers, disc players, or any other appliances. We do make every effort to keep everything in the best possible working order, which serves both the best interest of the Owner as well as the Tenant. In the event of an unexpected breakdown, we require the Tenant to report all needed repairs or damage to Carefree Vacation Homes immediately, and we will resolve the matter as quickly as possible. Carefree Vacation homes will arrange all repairs. Beach Time Rentals and the Owner reserve the right to enter the Premises for repairs and inspections. Beach Time Rentals may provide Tenant with substitute comparable accommodations for the same period without liability for the breach of contract. No refunds or rent reductions will be made due to failure of appliances or equipment. No refunds for reducing the number of night’s reserved or early departures. Any refund requests will need to be sent in within a month of departure in writing, responses will take up to 10 business days. ENTRY AND INSPECTION. Tenant agrees that Carefree Vacation Homes or its agents may enter the premises during reasonable hours to inspect the premises, to make such repairs, alterations or improvements thereto as Agent may deem appropriate, or to show premises to prospective purchasers or tenants. We reserve the right to enter the premises at any time for a property walkthrough. The tenant will be given a notice before we enter the premises. No notice will be given in case of an emergency. CHANGES: If Tenant requests to change properties, an approval to the owner will be submitted. If the change is approved there will be a $250 penalty. Changes cannot be made once payment is made in full. ENTRY CODES: House code will be provided by the property manager the day of check in. AGE REQUIREMENTS. We will not rent to vacationing students or singles under 25 years of age, unless accompanied by a parent(s). Any reservation made under false pretenses will be subject to eviction and forfeiture of advance payment of rent and deposits. NOTICES. Unless otherwise provided, any notice which either party may give or is required to give may be given personally by mailing the same, postage prepaid, to Tenant or our address shown in the signature block or at such other places as may be designated by the parties from time to time. Notice will be deemed effective five (5) days after mailing, or on personal delivery, or when receipt is acknowledged in writing. PROPERTIES FOR SALE. Occasionally, vacation residences are listed for sale. We reserve the right to show these properties to potential buyers. Every effort will be made to schedule showings so as not to interrupt your vacation. REVIEWS. Tenant agrees that Tenant will only participate in providing a review of Beach Time Rentals, Owner, or the Premises through the official Beach Time Rentals website. Tenant will not make or publish or instigate the making or publication of any statement (in verbal, written or electronic or other form) disparaging Beach Time Rentals, Owner or the Premises, or their past or present officers, employees, or agents whether or not such disparagement constitutes libel or slander, except as a valid review through the Cirrus system provided by Beach Time Rentals. ATTORNEYS` FEES. In the event that either party hereto is required to institute litigation or some other form of alternative dispute resolution to enforce the terms of this Agreement, the prevailing party shall be entitled to recover from the non-prevailing party all reasonable costs and attorney`s fees. APPLICABLE LAW AND VENUE. This Agreement shall be construed and interpreted in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. The parties hereto consent to the exclusive jurisdiction of the courts of either Pinellas County, Florida or the Middle District of Florida for any disputes relating to this Agreement. Tenant(s) acknowledge(s) that he/ she/they has/have read and agree to all terms and conditions. HURRICANE POLICY. At the discretion of the Carefree Vacation Homes, all, or a portion, of amounts paid by Tenant, may be refunded if the Tenant must vacate the Premises because the area where the Premises is located has fallen under a Hurricane Warning as issued by the National Hurricane Center. Tenant agrees to comply with any evacuation orders issued for the area, and will make reasonable efforts to secure the Premises prior to departure. DEFAULT; WAIVER. Should Tenant fail to fulfill the obligations under this Agreement, or violate any other term or condition of this Agreement, Carefree Vacation Homes shall then have the right to immediately re-enter the Premises and terminate this Agreement. Carefree Vacation Homes shall have all rights and remedies provided by law for Tenant's breach of, or noncompliance with, any of the covenants or agreements herein contained, all of which rights and remedies of Carefree Vacation Homes shall be deemed cumulative and not mutually exclusive, to the fullest extent permitted by law. It is mutually agreed between Carefree Vacation Homes and Tenant that Carefree Vacation Homes failure to take advantage of any default on the part of Tenant shall not be construed as a waiver thereof, nor shall any custom or practice that may develop between the parties during the Agreement term be construed to waive or to lessen the right of Beach Time Rentals to insist on strict and timely performance by Tenant of the provisions hereof. Each and every covenant and agreement hereof is of material importance to Carefree Vacation Homes. Failure by us to enforce any provision of this Agreement will not be deemed a waiver of that or any other provision. NON-LIABILITY. Neither Carefree Vacation Homes, Agents or Owner shall be responsible for any injury or damage to Tenant or the personal property brought onto the Premises by Tenant, which shall at all times be at the sole risk of Tenant, unless such injury or damage is the direct result of Carefree Vacation Homes or Owner’s gross negligence. NEITHER CAREFREE VACATION HOMES, AGENTS NOR OWNER SHALL BE LIABLE TO TENANT FOR ANY DAMAGE OR INJURY TO TENANT, OR TENANT'S FAMILY, INVITEES, OR PROPERTY, ARISING OR GROWING OUT OF ANYTHING OTHER THAN GROSS NEGLIGENCE OF CAREFREE VACATION HOMES, AGENTS OR OWNER, AS THE CASE MAY BE, AND TENANT AGREES THAT IT IS OCCUPYING THE PREMISES AT TENANT’S SOLE RISK. INDEMNIFICATION. Tenant agrees to hold Carefree Vacation Homes, Agents and Owner harmless from any claims for damages, no matter how caused. Tenant shall indemnify and hold harmless Manager and Owner, and their respective members, managers, officers, employees and agents, from and against any and all claims, lawsuits, investigations, penalties, liabilities, losses, costs, expenses (including reasonable attorney’s fees and expenses), and damages suffered or incurred by any of them arising out of or related to any act or omission by Tenant, except to the extent caused or contributed to (in whole or in part) by the gross negligence or intentional conduct of Manager and/or Owner. RENTAL ASSIGNMENT CHANGE. Carefree Vacation Homes reserves the right to change Rental Assignments without prior notice or liability in the event of a sale of the rental property, or if the unit becomes unavailable. When comparable accommodations are not available, Tenant will have the option of selecting from available properties or receiving a refund on the monies paid to Carefree Vacation Homes. CONSTRUCTION. Carefree Vacation Homes, agents or owner cannot be responsible for the failing of any other company due to said company’s error or service interruption {i.e. electricity, water, gas, cable, internet provider, etc.} and acts of neighbors such as: construction, road repair and maintenance or act of god (weather). However, Owners and Carefree Vacation Homes agree to do all that is possible to remedy any issue as quickly as possible. No refunds or adjustment of rental fees will be made for any of the above conditions. REPRESENTATIONS. Neither party has made any representations or promises, except as contained herein, or in some further writing signed by the party making such representation or promise. RADON GAS. The following disclosure is required by Florida law: "RADON GAS: Radon is a naturally occurring radioactive gas that, when it has accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county public health unit." PHOTOGRAPHY: Tenant is not allowed to use the home for photos or images for commercial use unless written permission is provided. MODIFICATIONS. This Agreement may not be changed, altered or modified orally or in any other manner other than by a written agreement signed by all the parties hereto. SYNTAX. Whenever used herein, the singular form shall include the plural, the plural form shall include the singular, and any gender or neuter form used shall include the other gender or the neuter form, as applicable. In the event the term Tenant is defined as more than one person, each such person is and shall be jointly and severally liable for the performance of each and every provision of this Agreement. SEVERABILITY. If any provision of this Agreement is determined to be invalid by any court of competent jurisdiction, the remaining portions shall nevertheless remain in full force and effect. BINDING EFFECT. All covenants and representations shall be binding upon and shall inure to the benefit of the heirs, executors, administrators and assigns of Carefree Vacation Homes and Tenant. TIME. Time is of the essence in this Agreement. NOISE ORDINANCE. There is a noise ordinance in effect after 10 pm and before 7 am. Please be a good neighbor and keep noise down at all times. If the neighbors call the police to the house due to a violation of this ordinance, YOU WILL BE ASKED TO LEAVE IMMEDIATELY WITHOUT A REFUND. GUESTS. In case of emergency, Carefree Vacation Homes requires the names and ages of every person
