This Agreement constitutes a contract between the Person and Persons known as Tenant and Sunsational Beach Rentals L.L.C., Managing Agent for the Owners. Sunsational Beach Rentals L.L.C. is the Agent of the Owner and will be compensated by the Owner. Vacatia Liberte Management, LLC, DBA

Reservation Deposits: All reservations require a deposit to confirm your reservation. Payment can be made by credit card, check, money order or cashier’s check (in U.S. funds).

Payment of Final Balance: All money (Rent, Tax and Condo Fee) is due at least thirty (30) days prior to arrival. Failure to pay balance due within thirty (30) days of arrival will result in forfeiture of the $200/$400 deposit. If the unit is reserved less than thirty (30) days prior to arrival, all money is due at the time the reservation is made. If the above is not followed, Agent reserves the right to cancel the reservation. All rates are subject to change without notice. Refunds or adjustments cannot be made for late arrival or early departures.

Cancellation: Cancellations must be received in writing at least 7 days prior to arrival date to avoid a one night penalty. Cancellations of reservations during peak season (February – April) and Holidays will be subject to 100% cancellation fee if the written notice is not received at least 30 days prior to arrival date. No refunds for early departures or no shows. Make sure this cancellation policy works for you. COVID-19 will not qualify as an extenuating circumstance.

Substitution of Unit: In certain circumstances beyond our control (fire, hurricane, sale of unit, etc.) your confirmed property may be unavailable upon your arrival. Sunsational Beach Rentals, LLC reserves the right to substitute your accommodations. Although we will do everything possible to create a pleasant vacation experience, neither Sunsational Beach Rentals, LLC or the owner are liable for damages or inconvenience in these rare and unusual situations.

Maximum Occupancy: The maximum occupancy of a Two Bedroom Unit is 6 persons; the maximum occupancy of a One Bedroom Unit is 4 persons.

Condition of Premises: You hereby acknowledge that you will not be entitled to any refund for any inoperative appliances, to include by way of example; television, air conditioning, dishwasher, washer/dryer, hottub or pool, etc. The Agent agrees upon notification by you of any malfunctions and shall make every reasonable effort to have such appliance or items promptly repaired in a timely manner.

Check In: Hours of check in are between 3:00-5:30 pm Mon-Sun. Office hours are 9:00am-5:30pm Mon-Sat & 9:00am-4:00pm on Sunday.

Late Arrivals: If Tenant plans to arrive outside of business hours, prior arrangements must be made with Agent.

Telephone Usage: Local service is provided at both properties at no charge.

Check-out: Check-out time is 10:00 a.m. Failure to comply with check-out time will result in additional monies due. Tenant should notify Agent if Tenant plans an early departure or a late check out

Keys: All keys that have been provided to the Tenant must be returned to the office upon departure. If you are departing early call the office to get the procedure to return keys for early departures. If Tenant fails to return these items, a fee will be deducted from the security deposit.

Valuables: Management and/or the Owner are not responsible for the loss of valuables.

Parking: One (1) assigned space per unit at Surf Beach Resort Condo/Hotel. One (1) parking permit is provided per unit at South Beach Resort Condo/Hotel and parking is on a first come basis.

Repair of Unit: For any repair problem, Sunsational Beach Rentals Tenant should contact the onsite office.

Dissatisfaction upon Arrival: Any cleaning problems should be reported in writing within 24 hours of arrival, excluding weekends and holidays. Also, any damages to unit and/or furnishings must be reported in writing within that same period previously mentioned. Failure to report dissatisfaction with cleaning or damages within the aforementioned time period will result in responsibility resting with the Tenant.

Replacement of Accommodations: If, for some reason, a given unit should become unavailable, Agent may provide the Tenant with replacement accommodations for the dates of the Tenant’s occupancy, whichTenant agrees to rent under the terms of the Agreement or Agent may cancel reservation by refunding all monies paid. Furthermore, should the premises be undergoing major repairs, redecorating, etc., Agent may provide replacement accommodations. Agent shall use its best efforts to attempt to provide replacement accommodations that are comparable to the original premises contemplated un der this Agreement. for some reason, a given unit should become unavailable, Agent may provide the Tenant with replacement accommodations for the dates of the Tenant’s occupancy, which Tenant agrees to rent under the terms of the Agreement or Agent may cancel reservation by refunding all monies paid. Furthermore, should the premises be undergoing major repairs, redecorating, etc., Agent may provide replacement accommodations. Agent shall use its best efforts to attempt to provide replacement accommodations that are comparable to the original premises contemplated under this

Termination of Rental: If the Tenant violates any of the conditions/restrictions of this Agreement, Tenant forfeits all monies paid and Agent may terminate the Agreement, which upon notice of such termination, Tenant shall vacate the premises immediately.

Entry into Premises: The Agent or authorized contractors for repair may enter the premises, with or without permission of the Tenant, during regular business hours, for any purpose connected with the repair, improvement, care and management of the premises. In case of Emergency, the Owner, Agent or Agent’s Contractors may enter at any time without permission of the Tenant.

Sale or Rental of Unit: If the unit is offered by Owner for sale at any time during the term of this Agreement, Tenant agrees to schedule an appointment for sales agents to show the unit to prospective purchasers at a convenient time within twelve (12) hours after each request by telephone, in person or by posting in writing on the unit front door. If Tenant fails to schedule an appointment within twelve (12) hours after each such request, sales agents may enter the unit thereafter without further notice toTenant.

Waiver of Terms: The Tenant agrees that the waiver of any term, covenant or condition of the Agreement shall not be taken nor construed to be the waiver of any other term, covenant or condition. TENANT’S RELEASE AND INDEMNIFICATION: TENANT HEREBY RELEASES, WAIVES AND DISCHARGES AGENT FROM ANY AND ALL LIABILITES, LOSSES, DAMAGES, CLAIMS, DEMANDS, ACTIONS AND CAUSES OF ACTION OF TENANT OF ANY NATURE AND KIND ARISING FROM OR AS A RESULT OF AGENT’S MANAGEMENT AND RENTAL OF THE UNIT TO TENANT, SPECIFICALLY INCLUDING BUT NOT LIMITED TO CLAIMS RELATED TO THE CONDITION OF THE UNIT. Tenant further agrees to indemnify and does hereby indemnify and hold Agent harmless from and against any and all liabilities, losses, damages, claims,demands, actions and causes of action of any nature and kind arising from or as a result of Agent’s management and rental of the unit to Tenant, specifically including but not limited to personal injury to any person or property damage or other expenses sustained by Tenant or any other person in connection with the unit. The words “TENANT” and “AGENT” used herein shall include their heirs, administrators, personal representatives, employees, agents, successors and assigns. Notices: All notices required by this Agreement shall be in writing and shall be mailed by U.S. Mail, registered or certified, to Tenant at Tenant’s address on the first page of this Agreement or at the unit address during the term of this Agreement or to Landlord or Agent at Agent’s address on the first page of this Agreement. Entire Agreement: This Agreement constitutes the entire Agreement between the parties hereto and no oral statements shall be binding upon either party.

Cancellation Policy:

If cancellation is at or within 7 days prior to arrival date the booking is subject to a cancellation fee of the first night's room rate plus taxes and fees.

If booking is during Peak Season or Holidays the cancellation must be received 30 days prior to arrival date or booking will be nonrefundable.

There are no refunds for early departures.

IMPORTANT: THE ATTACHED TENANT RESERVATION AGREEMENT IS PART OF YOUR RENTAL AGREEMENT AND MUST BE SIGNED.
